General terms:
‍You can use our services and visit our website without providing any personal information. Personal data is only collected if you voluntarily provide it to us during your visit to our website. Data is personal if it can be assigned to a specific or identifiable person. This includes, for example, details such as name, postal and e-mail address or telephone number, and possibly also usage data such as your IP address.
Logging of non-personal data when using our website
‍When you access our website or download data from the website or one of its subpages, information about this is stored and processed in a log file. This process is anonymized. Depending on the access protocol used, the log data record contains information with the following content:
Name of the requested file, the date and time of the page request
IP address of the requesting computer
access methods/functions requested by the requesting computer
the web page accessed or the name of the file accessed
operating system and browser type or settings
the amount of data transferred and the message whether the access/retrieval was successful
There is no possibility for us to link IP address and possibly existing personal data. The stored data is used exclusively for the purpose of identifying and tracking unauthorized access attempts/accesses to the web server as well as for statistical evaluations such as visitor numbers and page popularity and to improve our online offering. This data is used exclusively by us. It is not passed on to third parties.
E-mail advertising without newsletter registration and your objection
‍‍‍If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right, on the basis of Section 7 (3) of the German Unfair Competition Act (UWG), to regularly send you offers by e-mail for similar products to those already purchased from our range. This serves to protect our legitimate interests in addressing our customers in an advertising manner, which outweigh our interests in the context of a balancing of interests.
You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic rates.
Collection and use of personal data
In order for us to be able to provide certain services and process contracts, the collection of personal data is unavoidable. We then request and store your inventory data (name, address and company name) and your contact data (e.g. e-mail, telephone numbers). In addition, we process contract data (e.g. subject matter of the contract, term, customer category) and payment data (e.g. bank details, payment history).
If you provide us with personal data for the purpose of contacting us, this data will only be stored by us for as long as is necessary for the purpose of the respective communication and contact. As soon as the personal data is no longer required by us for these purposes and there are no longer storage obligations, it will be deleted immediately.
We use the collected data to answer your inquiries, to fulfill contracts, for service and customer care, marketing and market research, to comply with legal requirements and, if you have ordered it, to send you our newsletter. In order to provide our services to you, it may be necessary to share your personal data with companies that we use to provide the service or to process the contract. These are, for example, marketing newsletter service providers.
User data collected in connection with order processes and contract conclusions are stored and processed electronically for the purpose of payment processing and delivery.
You can revoke the declaration of consent you have given us at any time and object to the creation of user profiles at any time with effect for the future. In addition, you can - insofar as we use your personal data within the legally permissible scope for e.g. postal marketing measures - also object to this use. In both cases, it is sufficient to send an e-mail to the following address: tom@horsepoweragency.com.
Personal data collected from other sources
In the course of our cooperation with third-party service providers, we may receive personal data about you from these third-party service providers. These include, for example, business partners.
Legal basis for processing
In accordance with Article 13 DSGVO, we will inform you of the legal basis for our data processing activities. The legal basis for processing depends in each case on the purpose for which the data is processed.
If you have given us your consent for the processing of your personal data, we base the data processing on the consent you have given us in accordance with Art. 6 (1) a) DSGVO.
However, the processing of your personal data may also be necessary for the following reasons, such as the performance of a contract concluded with you or to carry out pre-contractual measures requested by you and to provide you with our services (e.g. feedback requests, online surveys about our business relationship, offers, invoices, payment reminders) as well as to fulfill our legal obligations (Art. 6 para. 1 p. 1 lit. a to c DSGVO). We also use your personal data pursuant to Art. 6 para. 1 p. 1 lit. f DSGVO to pursue our legitimate interests, provided that your rights and freedoms are not overridden.
Data transfer to third parties
We do not transfer your personal data to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if and to the extent that:
‍- you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO
- the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Art. 6 (1) sentence 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.
- there is a legal obligation for the disclosure pursuant to Art. 6 (1) sentence 1 lit. c DSGVO, and
this is necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you, such as in the case of transfer to external service providers who support us in our business operations. Our employees and partners are obligated by us to maintain confidentiality and to comply with data protection regulations.
Data transfer to third countries
When we share your personal data in accordance with this Privacy Policy, this may include transferring your personal data to countries outside the European Economic Area (EEA). If we transfer your personal data to countries outside the European Economic Area, we will always ensure that an adequate level of protection is in place there by ensuring, where required by law, that at least one of the following appropriate safeguards is in place:
Transfer of personal data to countries that the European Commission considers to provide an adequate level of protection for personal data (so-called "adequacy decision");
Use of specific contracts approved by the European Commission which ensure personal data the same level of protection as it enjoys in the EEA;
Transfer of personal data to an entity that provides a level of protection for personal data similar to the EU standard; or
Transfer of personal data to an entity that has implemented binding, internal data protection rules equivalent to the EU level of protection for personal data.
Storage period, deletion of personal data
The data processed by us will be deleted or restricted in its processing in accordance with Articles 17 and 18 DSGVO. Unless expressly stated within the scope of this data protection declaration, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. I.e. the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for reasons of commercial or tax law.
Your rights
You are entitled to various rights with regard to data concerning your person. You have a right to receive, upon request and free of charge, information about the personal data we hold about you, a right to rectify, delete or restrict the processing of this data and a right to object to the processing.
Whether and to what extent these rights exist in individual cases and which conditions apply is determined by the GDPR and the Federal Data Protection Act. According to the GDPR, you also have a fundamental right to data portability. Furthermore, if you have given your consent to the processing of your personal data, this consent can be revoked at any time with effect for the future.
If you have any questions, comments or requests regarding the collection, processing, use or deletion of your personal data by us, please contact tom@horsepoweragency.com.

Within the scope of hosting, all data to be processed in connection with the operation of this website is stored. This is necessary to enable the operation of the website. We process the data accordingly on the basis of our legitimate interests pursuant to Art. 6 (1) f) DSGVO. To provide our online presence, we use services of web hosting providers to whom we transmit the above-mentioned data.

Cookies
Our website uses cookies. These are small text files that your web browser stores on your terminal device. Cookies help us to make our offer more user-friendly, effective and secure. Some cookies are "session cookies." Such cookies are deleted by themselves after the end of your browser session. In contrast, other cookies remain on your terminal device until you delete them yourself. Such cookies help us to recognize you when you return to our website.
With a modern web browser, you can monitor, restrict or prevent the setting of cookies. Many web browsers can be configured to automatically delete cookies when you close the program. Disabling cookies may result in limited functionality of our website.
The setting of cookies, which are necessary for the exercise of electronic communication processes or the provision of certain functions desired by you, is based on Art. 6 para. 1 lit. f DSGVO. As the operator of this website, we have a legitimate interest in storing cookies for the technically error-free and smooth provision of our services. Insofar as the setting of other cookies (e.g. for analysis functions) takes place, these are dealt with separately in this data protection declaration.
Google Analytics
Our website uses functions of the web analysis service Google Analytics. The provider of the web analytics service is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google Analytics uses "cookies." These are small text files that your web browser stores on your terminal device and enable an analysis of website usage. Information generated by means of cookies about your use of our website is transmitted to a Google server and stored there. The setting of Google Analytics cookies is based on Art. 6 para. 1 lit. f DSGVO. As the operator of this website, we have a legitimate interest in analyzing user behavior in order to optimize our website and, if necessary, advertising.
IP-anonymization
We use Google Analytics in conjunction with the IP anonymization function. It ensures that Google truncates your IP address within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before transferring it to the USA. There may be exceptional cases in which Google transfers the full IP address to a server in the USA and shortens it there. On our behalf, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing us with other services relating to website activity and internet usage. There is no merging of the IP address transmitted by Google Analytics with other data from Google.
You can prevent the collection of your data by Google Analytics by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.
For more information on how Google Analytics handles user data, please see Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.
Leedfeeder
Simultaneously with the use of Google Analytics, this website uses the service Leadfeeder, which is operated by Liidio Oy, Mikonkatu 17, 0100 Helsinki, Finland. Leadfeeder accesses the list of website visitors' IP addresses provided by Google Analytics in the analysis and links the list of IP addresses to information about the companies that can be found on the Internet under these IP addresses. Due to the shortening of the IP addresses of the website visitors, which is already carried out when using Google Analytics, a direct personal reference is not established. A reference to a person may be presumed when reviewing the linked company information.
Browser Plugin
The setting of cookies by your web browser can be prevented. However, some functions of our website may be restricted as a result. You can also prevent the collection of data relating to your website usage, including your IP address and subsequent processing by Google. This is possible by downloading and installing the browser plugin accessible via the following link: https://tools.google.com/dlpage/gaoptout?hl=de.
Objection to data collection
You can prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be set that prevents the collection of your data during future visits to our website: Disable Google Analytics.
Details on how Google Analytics handles user data can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.
To fully comply with the legal data protection requirements, we have concluded an order processing agreement with Google.
Demographic characteristics with Google Analytics:
Our website uses the "demographic characteristics" feature of Google Analytics. It can be used to create reports that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google as well as visitor data from third-party providers. It is not possible to assign the data to a specific person. You can deactivate this function at any time. This is possible via the ad settings in your Google account or by generally prohibiting the collection of your data by Google Analytics, as explained in the item "Objection to data collection".
Google AdWords and Google Conversion-Tracking
Our website uses Google AdWords. The provider is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.
AdWords is an online advertising program. As part of the online advertising program, we work with conversion tracking. After a click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that your web browser stores on your terminal device. Google AdWords cookies lose their validity after 30 days and are not used to personally identify users. The cookie allows Google and us to recognize that you clicked on an ad and were redirected to our website. Each Google AdWords customer receives a different cookie. The cookies are not traceable through websites of AdWords customers. Conversion cookies are used to create conversion statistics for AdWords customers who use conversion tracking. AdWords customers learn how many users clicked on their ad and were redirected to pages with conversion tracking tag. However, AdWords customers do not receive any information that allows personal identification of users. If you do not want to participate in tracking, you can object to its use. In this case, the conversion cookie must be deactivated in the user settings of the browser. In this way, there will also be no inclusion in the conversion tracking statistics.
The storage of "conversion cookies" is based on Art. 6 (1) lit. f DSGVO. As the website operator, we have a legitimate interest in analyzing user behavior in order to optimize our website and our advertising.
Details on Google AdWords and Google Conversion Tracking can be found in Google's privacy policy: https://www.google.de/policies/privacy/.
With a modern web browser, you can monitor, restrict or disable the setting of cookies. Disabling cookies may result in limited functionality of our website.
Social Media
Our website uses buttons for each of the social networks:
LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland.
The buttons are marked with the logo of the respective social network. However, they are not the usual social plugins, but buttons with deposited links. The buttons must be activated (clicked) separately by you by clicking on them. Only when you click on the buttons and thus declare your consent to communication with the servers of the social network, the buttons become active and the connection is established.
By activating the button, the social network then also receives, among other things, the information that and when you have accessed the corresponding page of our website, as well as, for example, your IP address, details of the browser used and the language settings.
When activating the button, we have no influence on the collected data and data processing operations and are not responsible for this data processing and in this respect also not responsible in the sense of the DSG-VO.
For the purpose and scope of the data collection and the further processing and use of the data by the respective social network, as well as your rights in this regard and setting options for protecting your privacy, please refer to the information.

Profiling
You have the right not to be subject to a decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision
is necessary for the conclusion or performance of a contract between you and us,
is permitted by legal provisions of the Union or the Member States to which we are subject and these legal provisions contain appropriate measures to protect your rights and freedoms as well as your legitimate interests, or
is done with your express consent.
Changes to this privacy policy
We reserve the right to change this privacy policy at any time with effect for the future. A current version is available on our website. Please visit our website regularly and inform yourself about the applicable data protection provisions.
